Terms of Service – Shock Squad inc. Electrical
1. Scope of Work
All work performed by Shock Squad Inc Electrical is based on a written proposal or estimate provided to the Customer, whether residential or commercial. The proposal defines the scope of work, materials, specifications, and pricing.
Any work outside the original scope requires a written Change Order. Change Orders must be approved and signed by the Customer prior to additional work. Additional charges will apply.
2. Payment Terms
All invoices are due Net 10 (ten days) from the invoice date unless otherwise agreed in writing.
Contracted Projects (Residential & Commercial):
- Deposit (if applicable): As stated in proposal
- Progress Payment: Typically 70% due at rough-in (or agreed milestone)
- Final Payment: Remaining balance due upon substantial completion
Service / Time & Material Work:
- Labor billed at $75 per hour (rate subject to change with notice)
- Materials billed separately
- Minimum service charge may apply (125$ covers first hour)
Late payments may incur a 1.5% monthly finance charge (18% annually) or the maximum allowed by law.
Shock Squad, Inc. reserves the right to:
- Suspend work
- Withhold inspections, scheduling, or project closeout
- Remove crews from site
- Exercise lien rights as permitted by applicable law for unpaid balances
until all outstanding balances are paid.
The customer agrees to pay all costs of collection, including attorney fees, court costs, and lien-related expenses.
3. Commercial Client Terms
For commercial projects:
- Payment terms may be modified by written contract
- Retainage, if required, must be agreed upon in writing prior to project start
- Customer is responsible for providing approved plans, specifications, and coordination with other trades
Shock Squad Inc. is not responsible for delays caused by general contractors, project managers, or other subcontractors.
4. Residential Client Terms
For residential projects:
- Homeowner (or authorized representative) must be present or provide access as needed
- Customer is responsible for securing pets, valuables, and personal property
- Work areas must be accessible and reasonably clear
5. Permits, Inspections & Code Compliance
Unless otherwise stated, Shock Squad, Inc. will obtain required electrical permits and coordinate inspections.
All work will comply with applicable local codes and the National Electrical Code (NEC) in effect at the time of installation.
Shock Squad, Inc. is not responsible for bringing existing systems up to current code unless specifically included in the proposal.
6. Scheduling & Jobsite Conditions
Scheduling is based on availability, project requirements, and site readiness.
Customer agrees to:
- Provide safe, unobstructed access to all work areas
- Ensure jobsite readiness for scheduled work
- Coordinate with other trades (commercial projects)
Shock Squad, Inc. reserves the right to delay or stop work due to unsafe conditions, lack of access, or jobsite interference.
Any site-specific safety requirements or conditions beyond standard OSHA regulations must be communicated to Shock Squad, Inc. prior to the start of work.
7. Power Interruptions & System Risks
Electrical service may be interrupted during work.
Shock Squad, Inc. is not responsible for delays, outages, scheduling, or issues caused by the utility/power company.
Shock Squad, Inc. is not responsible for:
- Damage to electronics, appliances, or equipment
- Data loss or downtime (including business operations)
- System resets or failures
The customer is responsible for protecting sensitive equipment and notifying occupants/employees of outages.
8. Change Orders
All changes must be documented in a written Change Order signed by the Customer before additional work begins. Verbal approvals will not be accepted.
Change orders must be approved in reasonable time.
9. Unforeseen Conditions
Hidden or unknown conditions (including outdated wiring, code violations, or structural limitations) may require additional work.
Shock Squad, Inc. will notify the Customer and provide a Change Order for approval before proceeding.
Shock Squad, Inc. is not responsible for unforeseen underground conditions, including rock, buried debris, unmarked utilities, or other subsurface obstructions
10. Customer-Supplied Materials
Shock Squad, Inc. does not warranty or guarantee customer-supplied materials or equipment.
Shock Squad, Inc. is not responsible for delays, defects, or additional labor associated with such materials.
11. Warranty
Shock Squad, Inc. provides a one (1) year warranty on workmanship and installed materials from the date of substantial completion.
This warranty does not cover (including but not limited to) :
- Misuse, abuse, or neglect
- Work modified or repaired by others
- Pre-existing conditions or third-party equipment
- Normal wear and tear
Warranty claims must be reviewed and approved by Shock Squad, Inc. prior to repair.
If Shock Squad, Inc. responds to a service or repair request that is determined to be outside the scope of the applicable warranty coverage, additional service and repair charges may apply.
12. Limitation of Liability
Limitation of Liability
To the fullest extent permitted by applicable law, Shock Squad, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the services provided, including but not limited to:
- Loss of use or occupancy
- Business interruption, lost profits, or lost revenue
- Delays caused by utility companies, inspections, weather conditions, material shortages, or other third parties
- Damage resulting from concealed, unknown, or pre-existing site conditions
- Unforeseen underground conditions, including rock, buried debris, or unmarked utilities
- Property damage outside the direct scope of work performed
Shock Squad, Inc.’s total liability for any claim, damage, or loss arising out of or related to the services provided shall be limited to the total amount paid to Shock Squad, Inc. for the specific services giving rise to the claim.
13. Delays Beyond Control
Shock Squad, Inc. is not responsible for delays caused by:
- Weather
- Material shortages
- Inspection or permitting delays
- Other contractors or trades
- Events beyond reasonable control
Project timelines are estimates unless guaranteed in writing.
14. Right to Stop Work / Termination
Shock Squad, Inc. reserves the right to stop work for:
- Non-payment
- Unsafe conditions
- Interference by Customer or third parties
- Requests that violate code or safety standards
Remobilization may result in additional charges.
15. Mechanic’s Lien Rights
Shock Squad, Inc. reserves the right to file a mechanic’s lien for unpaid balances in accordance with applicable state laws.
16. Insurance & Liability
Shock Squad, Inc. maintains appropriate licensing and insurance. Proof of insurance is available upon request. (Liability, umbrella, and workmans comp)
The customer is responsible for maintaining property insurance (residential or commercial) covering the project site.
Bonds are obtained as required
17. Cleanup & Disposal
Shock Squad, Inc. will perform standard jobsite cleanup. Removal of hazardous materials, excessive debris, or non-project waste is not included unless specified.
Removal of underground spoils is per contract.
18. Governing Law
These Terms shall be governed by the laws of the state in which the work is performed.
19. Entire Agreement
These Terms, along with the proposal and any approved Change Orders, constitute the entire agreement.
20. Acceptance of Terms
By approving a proposal, signing an estimate, or allowing work to begin, the Customer agrees to these Terms of Service.
